Human rights law in Cambodia and the art of linking continuities to discontinuities

This paper suggests that development of human rights law in Cambodia should be examined within the existing transitional context where continuities of past legal legacy and discontinuities attempted by new efforts to bring in reforms and changes are interacting in a very complicated and specific manner. Telescopic observation of changes at each specific area of human right law, based on relevant elements including historical, ideological, structural, institutional considerations, is a useful way of understanding these complicated interactions. By applying this approach in reviewing the development of constitutionalism in Cambodia since 1993 and subsequent legislative and administrative measures taken in the field of freedom of expression and promotion of labour rights, this research shows how development of human rights in Cambodia can be explained pragmatically in the context of the “changing” interactions between continuities and discontinuities of existing legal cultures following the different waves of legal and political transitions, including but not limited to those at the aftermath of the democratization process in the early 1990s.
