In article the functional purpose and a procedure of activity of the trainee and assistant of advocate by the legislation of a number of the states which were earlier a part of the Union of the Soviet Socialist Republics (Belarus, Ukraine, Moldova, Kazakhstan, Kyrgyzstan, Estonia, Armenia, Azerbaijan, Georgia, Uzbekistan) are considered. As a result of research some aspects of the studied problem in relation to perfecting of the relevant provisions of the legislation of the Russian Federation are designated.
