This article deals with the comparative characteristics of the legal regulation of maternity capital in Belarus and Russia. The goal of these countries is the maintenance and protection of families with children. These countries provide a considerable number of types of financial assistance to families with children. One of these types is the maternity (family) capital. This type of social benefit fulfills the demographic function as well as the function of material support for families with children, however, this type of assistance has problematic issues.
